Terms of Service

1. Service

SitePrior provides automated property screening reports compiled from publicly available federal data sources. Reports are informational screening documents only. They are not engineering certifications, sealed engineering opinions, geotechnical investigations, wetland delineations, surveys, Phase I or Phase II Environmental Site Assessments, FEMA Letter of Map Amendments (LOMAs), elevation certificates, or appraisals, and they may not be used or represented as any of those. 2. No professional relationship

Purchasing or receiving a SitePrior report does not create an engineer-client, attorney-client, fiduciary, agency, or other professional relationship between you and SitePrior, SitePrior, LLC, its members, employees, contractors, or affiliates. SitePrior reports are not personalized professional advice, are not signed or sealed by an engineer, and must not be relied upon for permit submittals, regulatory filings, design decisions, transaction-closing decisions, or insurance underwriting. For any of those uses, retain a state-licensed professional in your jurisdiction.

3. No warranty

The service and all reports are provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, currentness, or availability. SitePrior reproduces data from third-party federal sources (FEMA, USDA, USGS, USFWS, NOAA, EPA, U.S. Census, and others). SitePrior does not independently verify, audit, ground-truth, survey, or warrant the accuracy of those datasets, and is not responsible for upstream errors, omissions, mapping inaccuracies, panel revisions, or service outages by those sources. Federal data is updated on the publishing agency's schedule, not ours; a report reflects what those sources returned at the moment of generation.

4. Pricing & refunds

Single reports are $29, prepaid. Five-packs are $99 with no expiration. Realtor Unlimited is $199/month, cancellable at any time.

Refund policy: If a report fails to generate, or if any data layer is unavailable for your location at the time of purchase, you receive an automatic full refund. Successfully delivered reports are non-refundable, regardless of whether the underlying federal data later turns out to be incomplete, outdated, or in error.

5. Acceptable use

You agree not to: scrape or automate report generation outside provided plans; resell reports as your own work product; use reports for permit submittals or regulatory filings (they are not stamped engineering documents); represent SitePrior reports as the work of a licensed engineer, surveyor, or other regulated professional; reverse-engineer the service.

6. Intellectual property

Underlying federal datasets are public domain. The compiled report (layout, interpretation, summary text) is © SitePrior, LLC. You may share an individual report you purchased with anyone (buyer, agent, lender, contractor) without restriction.

7. Limitation of liability

To the maximum extent permitted by law, SitePrior, LLC, its members, managers, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, the service or any report — including but not limited to loss of property value, failed real-estate transactions, permit denials, insurance disputes, construction cost overruns, foundation or structural damage, regulatory enforcement actions, or third-party claims — even if SitePrior has been advised of the possibility of such damages.

SitePrior's total aggregate liability for any and all claims arising from or related to the service or a report shall not exceed the greater of (a) the amount you paid for the specific report(s) at issue, or (b) one hundred U.S. dollars ($100). This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and survives termination of these terms.

8. Indemnification

You agree to indemnify, defend, and hold harmless SitePrior, LLC and its members, managers, employees, contractors, and affiliates from any third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (i) your use of a SitePrior report, including reliance on it for any purpose other than informational screening; (ii) your sharing or republication of a report to any third party; (iii) any representation by you that a report constitutes engineering, legal, or other professional advice; or (iv) your violation of these Terms.

9. Governing law & disputes

North Carolina law governs these terms, without regard to conflict-of-laws principles. Any dispute arising from or related to the service or these Terms shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Buncombe County, North Carolina, except that either party may bring an individual claim in small-claims court if it qualifies. You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class, consolidated, or representative action. Any claim must be brought within one (1) year of the date the claim accrued or it is permanently barred.

10. Changes

We may update these terms with 30 days' notice posted on this page. Continued use after the effective date constitutes acceptance.
