How to check a property for wetlands before you make an offer

Wetlands are the due-diligence item that most reliably turns a cheap lot into an expensive mistake, because nothing about them shows up at a Saturday showing in July. Here's the screening sequence engineers actually use — what the free federal maps can tell you, what they can't, and when to spend real money on a delineation.

Why this is the sneaky one

A flood zone is printed on a map with regulatory force. Wetlands aren't — the authoritative boundary doesn't exist until someone walks the site and flags it. The federal screening maps are inventories, drawn from aerial photography, and they miss exactly the wetlands most likely to burn a buyer: small forested seeps, seasonally saturated swales, the corner of the lot that's only wet in March. Meanwhile, filling a jurisdictional wetland without a permit is a federal Clean Water Act violation whether or not you knew it was there.

The screening sequence

Step 1 — NWI: the mapped inventory

The U.S. Fish & Wildlife Service National Wetlands Inventory maps wetland polygons nationwide with a classification code (forested, emergent, pond, etc.). Read it exactly this way: a polygon on the lot is a strong flag that jurisdictional wetlands exist; a clean screen is weak evidence of absence. NWI is photo-interpreted at landscape scale — it under-maps forested and seasonal wetlands, and its edges wander at parcel scale.

Step 2 — hydric soils: the memory of water

Soils that formed under saturation keep the signature for centuries — gray, low-chroma colors, organic surface layers. The USDA soil survey (SSURGO) rates every mapped soil for hydric status. A hydric or partially hydric map unit on the buildable area means the ground has spent long stretches saturated, whatever it looks like in a dry August. Hydric soils plus an NWI polygon is close to a confirmed problem; hydric soils alone still justifies walking the site with wet eyes.

Step 3 — the terrain and the stream network

Wetlands live where water collects: toe-of-slope seeps, floodplain margins, closed depressions, drainage heads. A lot that contains the low point of the neighborhood, borders a mapped stream, or shows a flat spot in an otherwise sloping parcel deserves suspicion the maps can't resolve.

Step 4 — the field look (free, imperfect, worth it)

Legally, a wetland requires all three — hydrophytic vegetation, hydric soil, wetland hydrology (1987 Corps Manual + regional supplements). If you can see two of the three yourself, price the delineation into the deal.

Step 5 — the real answer: delineation and jurisdictional determination

A qualified consultant flags the boundary in the field; the Army Corps of Engineers can confirm it as a jurisdictional determination. For a residential-scale lot this is a few thousand dollars — the cheapest insurance in land buying when any of steps 1–4 raised a flag. Make the offer contingent on it.

What getting it wrong costs. Filling jurisdictional wetlands without a Section 404 permit exposes you to stop-work orders, restoration requirements (removing your fill and replanting), and civil penalties. If the impact was permittable at all, an individual permit means an alternatives analysis and compensatory mitigation — mitigation-bank credits routinely run tens of thousands of dollars per acre. The delineation you skipped costs a few thousand. This asymmetry is the entire argument.

"But didn't the Supreme Court change all this?"

Partly. Sackett v. EPA (2023) narrowed federal jurisdiction to wetlands with a continuous surface connection to relatively permanent waters — so some isolated wetlands are no longer federally regulated. Two cautions before you celebrate: the call is technical and site-specific (you still need the determination), and many states regulate wetlands beyond the federal floor. A federally non-jurisdictional wetland can still be fully protected under state law, and can still be a terrible place for a foundation or a septic field regardless of what any agency says.
